An ordinance that would make it illegal for anyone to camp or maintain an encampment on public property in the city of Fremont is up for a vote on Tuesday night.

Fremont’s plan to ban homeless camps anywhere in the city has the potential to be the most forceful response yet in the Bay Area to a landmark U.S. Supreme Court ruling this summer granting officials broad authority to police homelessness — and could have ripple effects across the region.

The council is considering passing an ordinance that would restrict camping on both public and private property. It would also prohibit “permitting, aiding, abetting or concealing” someone who is camping. Violators could face a fine of up to a thousand dollars or six months in jail.

Fremont's City Council on Tuesday is set to vote on an ordinance that would make it unlawful for any person to camp on any public property including any street, sidewalk, park, open space, or waterway.

A new proposal in Fremont would not only target homeless encampments but also make it a crime to help those encampments continue to operate. The city council will be taking its final vote on the so-called camping ordinance Tuesday night.
